Terms of Service

These terms govern your use of Daemon, a hosted and self-hostable software agent. By subscribing to a hosted plan you agree to them.
1. Who you are contracting with
Daemon is operated by an individual proprietor based in India. Payments are collected by Lemon Squeezy, which acts as merchant of record and is the seller for tax purposes. Your receipt comes from them; your service comes from us.
2. What the service is
On a hosted plan we run an instance of the software for you on a server we control. It connects to chat accounts you provide, runs an AI agent on your instructions, and stores what that agent produces. What each plan includes is described on the pricing page and enforced in software.
The agent is powered by Anthropic’s Claude models. We provision and manage the API access on your behalf and model usage is included in your plan up to its stated ceiling, so you have one bill and no account to open elsewhere. What we sell is the running agent, not model access itself. Your use of the models through the service is also subject to Anthropic’s usage policies, which we pass through.
3. Your credentials
You are responsible for the accounts you give the agent: your Telegram bot token, your WhatsApp number, your Slack app tokens, and any third-party tokens you configure. Give it the narrowest access that lets it do the job. You are responsible for everything done through your instance, including by people you add to its allowlist.
4. What the agent may do
The agent runs real commands and takes real actions. A permission gate blocks a set of destructive operations and hosted instances are further restricted. For the first fourteen days of a hosted plan the instance is read-only: it reports what it would have done and changes nothing. After that, any action the software recognises as moving money or contacting one of your customers waits for your approval and is refused if none is given. None of this is a guarantee. An agent acting on your behalf can make mistakes on your behalf. You accept that risk when you connect a system to it.
You must not use the service to send unsolicited bulk messages, to break the terms of a platform you connect it to, or to do anything unlawful. WhatsApp connectivity uses an unofficial linked-device protocol; WhatsApp may suspend a number used this way, and we are not responsible if it does.
5. Payment and cancellation
Subscriptions are billed in advance and renew until cancelled. You may cancel at any time, effective at the end of the period already paid for. Refunds are governed by our refund policy.
If a payment fails, your instance keeps full entitlements for seven days, then drops to reduced limits rather than stopping. We may suspend an instance unpaid for thirty days and delete its data thirty days after that, telling you first.
6. Your data
Your conversations, files and agent memory are yours. We store them to provide the service and hold nightly backups for fourteen days. We do not sell them and do not use them to train models. You may request an export or deletion at any time.
7. Availability
We aim to keep instances running and will restore service promptly, but plans below Enterprise carry no service level agreement and no uptime guarantee.
8. The licence
The source is available under the Elastic License 2.0. You may run, modify and self-host it freely. You may not offer it to third parties as a hosted or managed service, and you may not remove or circumvent its licence-key functionality.
9. Warranties and liability
The service is provided “as is”, without warranties, to the fullest extent the law allows. We are not liable for indirect or consequential loss, lost profits, or loss of data beyond our backup obligations. Total liability for any claim is limited to what you paid us in the three months before it arose, and the reimbursement in our refund policy for an unapproved money-moving action is the sole remedy for it. Nothing here excludes liability that cannot lawfully be excluded.
10. Governing law
These terms are governed by the laws of India, and the courts of Gujarat have exclusive jurisdiction, except where mandatory consumer protection law in your own country gives you rights you cannot contract out of.
